These Terms of Service ("Terms") constitute a binding agreement between you and Next Level Athlete, LLC ("VAI," "we," "us," or "our"), the operator of GAME OS and related services. By accessing or using GAME OS you confirm that you are at least 18 years old and agree to be bound by these Terms.
"Affiliate" means any person who refers paying customers to VAI through the referral program. "AI Features" means AVANTI and any other artificial-intelligence-powered functionality within the platform. "Fees" means subscription charges, Maintenance Fees, and any other amounts owed under these Terms. "Tokens" means digital utility credits usable within the VAI ecosystem.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.
GAME OS is offered on a subscription basis with pricing as displayed at the time of purchase. If you maintain a free-tier account and earn more than $50 USD in referral commissions in any calendar month, you agree to a $14.95 monthly Maintenance Fee. All fees are non-refundable except as required by applicable law.
Referral commissions are subject to reversal for refunds, chargebacks, or violations of these Terms. VAI reserves the right to modify commission rates with 30 days' notice. The affiliate program is available to eligible users in jurisdictions where permitted by law.
AVANTI and all AI-powered features are provided for informational and operational purposes only. AI outputs are not guarantees of athletic performance, eligibility outcomes, recruiting results, or income. You assume full responsibility for decisions made based on AI-generated content.
Tokens are non-security utility credits with no guaranteed monetary value, are non-transferable except as expressly permitted, and may not be redeemed for cash. VAI reserves the right to modify or discontinue the Token system at any time.
All content, trademarks, software, and technology within GAME OS are owned by or licensed to VAI. You may not reproduce, distribute, or create derivative works without our prior written consent.
To the maximum extent permitted by law, VAI's total liability to you for any claim arising from these Terms or your use of GAME OS is limited to the amounts you paid to VAI in the three months preceding the claim, or $100 for free-tier users. VAI is not liable for indirect, incidental, or consequential damages.
Any dispute arising from or relating to these Terms shall be resolved through binding arbitration administered in the State of Delaware under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.
GAME OS is not directed at children under 13. If we become aware that a child under 13 has provided personal information without verifiable parental consent, we will delete that information promptly. Parents or guardians who believe their child has submitted information should contact us at support@vai.app.
We may update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised date. Continued use of GAME OS after changes constitutes acceptance of the new Terms.

We collect information you provide directly (name, email, organization details, payment information), information generated through your use of GAME OS (roster data, athlete records, scheduling, compliance records), and technical information (device type, IP address, usage logs).
We use your information to provide and improve GAME OS, process payments, send operational communications, power AVANTI AI features, comply with legal obligations, and prevent fraud. We do not sell your personal information to third parties.
Roster and athlete data entered into GAME OS is controlled by the organization (club, league, or school) that created the records. We process this data solely on their behalf. For athletes under 18, organizations are responsible for obtaining appropriate parental consent before entering data into the platform.
We share data only with service providers necessary to operate GAME OS (cloud hosting, payment processors, email delivery), when required by law, or with your explicit consent. All third-party providers are bound by data processing agreements consistent with applicable privacy law.
We implement industry-standard security measures including encryption in transit and at rest, access controls, and regular security reviews. No system is completely secure; you use GAME OS at your own risk and should notify us immediately of any suspected breach.
We retain your data for as long as your account is active or as needed to provide services. Upon account termination you may request deletion of your data, subject to legal retention requirements and legitimate business needs.
Depending on your jurisdiction, you may have the right to access, correct, delete, or export your personal data. To exercise these rights, contact us at support@vai.app. We will respond within 30 days.
GAME OS uses cookies and similar technologies to maintain sessions, analyze usage, and improve performance. You can control cookies through your browser settings, though disabling them may affect functionality.
We may update this Privacy Policy from time to time. Material changes will be communicated by updating the date on this page. Continued use of GAME OS following changes constitutes your acceptance.
